The Glens Falls Farmers Market Association (hereinafter “GFFMA”), a 501(c)(3) nonprofit organization, offers sponsorship opportunities to individuals, businesses, and organizations ("Sponsors") in support of its mission to foster local agriculture, entrepreneurship, and community engagement.
By entering into a sponsorship agreement with GFFMA, the Sponsor agrees to the following terms:
Sponsorships are considered qualified sponsorship payments under IRS Section 513(i) and are distinct from advertising. GFFMA may recognize sponsors with:
Name, logo, and general contact information on banners, signage, programs, newsletters, social media, and its website.
Mentions thanking the sponsor without calls to action or product endorsements.
Sponsors shall not receive:
Comparative language (e.g., “best in town”),
Qualitative or promotional statements,
Pricing information or inducements to buy, sell, or use products/services.
All promotional content will be reviewed and must be approved by GFFMA.
GFFMA reserves the right to:
Approve or reject any potential sponsor whose values or offerings are inconsistent with the market's mission.
Revoke sponsorship at any time if the sponsor engages in conduct that could harm the reputation of the market or its members.
Sponsors shall not use the name, logo, or branding of the Glens Falls Farmers Market without prior written approval. Any such use must adhere to the market’s brand guidelines.
Sponsorship does not imply endorsement of any sponsor, product, or service by GFFMA. Marketing materials shall not suggest an endorsement or exclusive relationship.
The term and specific benefits of each sponsorship will be outlined in a separate Sponsorship Agreement signed by both parties. GFFMA reserves the right to adjust placement or exposure due to space, time, or design limitations.
GFFMA is a registered 501(c)(3) nonprofit. Sponsorships that result in a public acknowledgment but do not provide advertising benefits may be treated as qualified sponsorship payments, which are not tax-deductible as charitable contributions but may be deductible as a business expense.
Sponsors are encouraged to consult their tax advisor for guidance.
Sponsorship payments are non-refundable unless otherwise stated in writing. If the market is canceled due to acts of nature or public safety, GFFMA will work with sponsors to reschedule or apply their support to future opportunities.
GFFMA is not liable for any indirect, incidental, or consequential damages resulting from the sponsorship relationship or sponsor’s participation in market events or promotions.
GFFMA shall not be held liable for failure to fulfill obligations if such failure is caused by acts beyond its control (e.g., weather, fire, public health emergencies, acts of government).
This agreement shall be governed by the laws of the State of New York. Any disputes shall be resolved under the jurisdiction of Warren County.
Sponsor data collected via this website or sponsorship forms will be used solely to administer the sponsorship program and will not be sold or distributed without consent.
